Town Wins crucial legal battle allowing work to move forward on the Crescent Beach seawall and revetment.

The Town of Hull has prevailed in its lawsuit about the Crescent Beach Seawall and Revetment Repair Project. This project was abandoned by the construction company hired to perform the repairs. In exchange for dismissing the lawsuit, the Town received $6,658,900.00 from Allied World Insurance Company. This settlement exceeded the amount of Allied World’s bond by over $1,000,000.00, representing a significant win for the town.

After the contractor abandoned the project, the Town engaged contractors to make needed improvements to the seawall and revetment to provide enhanced storm protection during the ongoing legal dispute. However, further work remained necessary to give the neighborhood residents and the surrounding environment the storm protection the original project was designed to provide. This settlement with the bonding company will allow the Town to end this longstanding legal dispute and move forward with the outstanding repair work after securing the necessary state and federal approvals.

This settlement exceeds the estimated cost of completing the work, allowing the town to avoid the additional time, effort, expense, and uncertainty of bringing our case all the way to trial and into potential appeals by the insurance company. This result finally allows the town to move ahead with the completion of this important project.
